Act within 24 hours — it's essential

A workplace accident triggers a chain of procedures that must be carried out quickly. You must notify your employer within 24 hours of the accident (except in cases of force majeure). Your employer must then declare the accident to CPAM within 48 hours. If your employer doesn't do it, you can declare it yourself directly to CPAM within 2 years — but don't wait.

The medical consultation: the most important document

See a doctor as quickly as possible after the accident — ideally the same day. Explicitly tell them that the accident occurred during your work so they can issue an initial medical certificate stating "workplace accident" (accident du travail). This certificate is the founding document of your case. Without it, your accident may not be recognised as a workplace accident.

Your rights if the accident is recognised

Recognition as a workplace accident comes with significant advantages over ordinary sick leave: medical care covered at 100% with no upfront payment, higher daily allowances (60% of salary for the first 28 days, then 80%), stronger protection against dismissal during incapacity, and the possibility of a permanent annuity in case of lasting consequences.

Your employer disputes it — what to do?

If your employer disputes the professional nature of the accident (by filing motivated reservations within 10 days of the declaration), CPAM opens an investigation. During this time, continue to receive medical treatment normally. Gather statements from colleagues who were present at the time of the accident — these can be decisive in CPAM's final decision.

Commuting accidents: also covered

An accident occurring on the journey between your home and your workplace is also covered as a workplace accident. The condition: the route must be direct, without any notable detour for personal reasons. If in doubt about the classification, declare the accident — CPAM decides, not you.
